Survivor's pension - conditions, amount, and procedure for receiving. All about the survivor pension How much do they pay for the loss of a survivor for children?

The size of the survivor's pension in 2017, as well as the procedure for its indexation, differs from those for insurance pensions.

The size of the survivor's pension in 2017 worries many. As a rule, a family's income consists of the earnings of its adult members.

And the death of such a breadwinner becomes not only grief, but also a complete deprivation of the source of existence.

However, the state provides assistance to such citizens and assigns a pension, which is called the loss of a breadwinner.

What is it about

The loss of a breadwinner means not only his physical death. In some cases, a court can establish such a fact.

This happens if a citizen is declared missing or dead.

In all cases, his dependents are entitled to state support in the form of pensions and benefits.

Strictly speaking, there are several types of survivor's pension:

  • insurance;

The family, or rather dependents, of an officially working citizen can apply for insurance. That is, having at least one day of service counted as insurance.

The longer the length of service, the higher the survivor’s pension in 2017.

The state pension is paid to the families of certain categories of government employees: military personnel, astronauts, liquidators of the consequences of man-made disasters, etc.

The amount of benefits and the procedure for their assignment are regulated by relevant laws.

A social pension is paid if the deceased citizen did not have insurance coverage.

Or if members of his family have lost the right to receive an insurance pension. However, they may not have it at all.

Payments of all types of pensions, except insurance, are made from the federal budget. And the insurance company comes from the Pension Fund.

Only one pension can be assigned; receiving similar payments on two grounds is impossible.

Social pension instead of insurance

There are only three cases when a social pension is assigned instead of an insurance pension for the loss of a breadwinner.

  1. The deceased or recognized as such citizen did not have an insurance record. This could happen for various reasons. For example, he did not work officially. When hiring in accordance with the norms of the Labor Code of the Russian Federation, the employer makes insurance contributions to the Pension Fund for each of its employees. They also have insurance experience, since they make contributions to the Pension Fund on their own behalf every year.
  2. The loss of a breadwinner occurred as a result of a crime committed against him by one of his dependents. The presence or absence of insurance experience in such a case does not matter. The social pension will be established on the basis of a court decision.
  3. Family members of a serviceman who died in the process or from the consequences of a crime he committed will also receive such a payment. Dependents in this case cannot count on a state pension, since their breadwinner has lost the right to it.

Who can apply

All disabled members of his family can apply for payment of the full amount of the insurance pension for the loss of a breadwinner in 2017.

That is, children, spouses, as well as parents, including adopted ones. In some cases, siblings are also included in the list.

In this case, disability should be understood as:

  • inability to work due to age (up to 18 years old, and full-time students up to 23 years old);
  • reaching a certain age (55 and 60 years for women and men, respectively);
  • disability, or degree, regardless of age;
  • care for children under 14 years of age.

The circle of social pension recipients is somewhat narrower. It includes only minor children, both of whose parents died or initially there was only one (single mother, less often single father).

Disabled children have the right to such payment at any age, even after reaching adulthood.

When studying full-time at a state university, the age limit is pushed back to 23 years.

The budgetary or commercial basis of training does not matter.

Expulsion from an educational institution automatically deprives you of the right to receive a survivor's pension in 2017.

The same happens when you get married before the age of 18 or get official employment.

The status of deceased parents in an official marriage does not matter. If both of them recognized the child, he is entitled to a pension.

Retired parents or other dependent relatives will receive social or insurance payments in any case.

Just like unemployed relatives who took care of the orphaned children.

How much will they pay

You should not think that the size of the survivor's pension in 2017 will increase significantly.

According to statistics, the average benefit in 2016 did not exceed 10,000 rubles.

And this takes into account the indexation of 4%. However, the Government promises to index pensions in 2017, twice: in February and April.

What does this amount consist of? The calculation is made by sequentially multiplying the insurance pension by the pension coefficient established for each category and the cost of such coefficient.

Therefore, it is not possible to name the exact amount due to the dependents of the deceased breadwinner.

Exceptions to the general rule establishing relatively low pensions will be the families of high-ranking officers or holders of state orders.

Their pension is approximately three times the average. Which, given the merits of the deceased officer, is quite fair.

How to apply for such a pension

Whatever its size, it is not issued automatically. To receive it, you must make a personal visit to the Pension Fund.

If there are minor children, this will have to be done by the relative who turns out to be their legal representative after the loss of their parents.

Or an employee of a child care institution, where they will be assigned by the guardianship authority.

The basis for considering the issue of accruing a pension will be a personal statement. It is written by hand in a certain form.

The sample is presented on the Pension Fund’s website and on information stands in its territorial branches.

The text should indicate the reasons for providing assistance and a list of dependents.

You will first have to open an account to which payments will then be regularly transferred. You will also need to attach several documents:

  • applicant's passport;
  • death certificate;
  • confirmation of relationship with the deceased;
  • certificate of the breadwinner's earnings.

After reviewing the application and checking the information contained in the document, the Pension Fund will begin processing the pension.

There is no need to re-register documents in the future. Another visit will have to be made only if the child of the deceased breadwinner, upon reaching 18 years of age, continues to study.

Survivor's pension

One of the types of pension insurance in the Russian Federation is payment in the event of the loss of a breadwinner. Its main points are regulated by law “About insurance pensions”, namely:

  • conditions of appointment;
  • establishing the circle of persons entitled to it;
  • determining the amount of pension;
  • terms and methods of payment and delivery.

The main recipients of this type of pension provision are children of a deceased breadwinner, although the full circle of persons is not limited only to them. To establish compensation for the future recipient (parent, guardian), it is necessary contact the Pension Fund at your place of residence with a package of documents. The period for their consideration will be 10 working days. In some cases, this period can be extended to three months.

The main condition for obtaining insurance coverage is disability its recipient. However, the establishment of insurance amounts is not limited only to this requirement - their range is much wider.

It is also worth noting that some facts may lead to a complete termination of the payment of insurance coverage, as stated in Art. 25 law “About insurance pensions”.

Who is entitled to receive a pension after the death of the insured person?

According to Art. 10 of the above law have the right to the relatives of the deceased who meet the basic requirement - being a dependent breadwinner during his lifetime.

Establishment of family ties is carried out in accordance with the norms of family law. Among the category of close relatives entitled to pension benefits in the event of the loss of a breadwinner, the following can be distinguished:

  • Minor children, brothers, sisters, grandchildren. After turning 18 years old, their rights are retained in two cases:
    • up to 23 years of age upon admission to study (it is important to study full-time);
    • for life if you become disabled by this age.
  • Parents, spouse, grandmother, grandfather who have reached the age of a pension recipient or who have lost their ability to work.

There is also peculiarity determining the right to payment after the death of the insured person for the category of adult relatives caring for children or immediate relatives of the deceased, under 14 years of age. In this case, it will not be a prerequisite for them to be dependent on the breadwinner, but the absence of official work activity will have a decisive role. Such persons include parents, spouse, grandparents.

We should also not forget that adopted children have the right to pension provision on equal terms with their own children, and adoptive parents have the right to equal rights with their parents. Upon adoption, minor children also retain the right to this type of pension.

The amount of survivor's pension in 2019

For the loss of a breadwinner will depend on several components:

  • quantity and deceased;
  • the duration of the breadwinner’s work, as a result of which they were transferred to his personal account.

To calculate the amount of payment is used general formula:

SP = IPK x SPK + FV,

  • JV- the amount of insurance pension for the loss of a breadwinner;
  • IPC- the value of the individual pension coefficient of the breadwinner;
  • SPK- the cost of one such point on the day of payment;
  • FV- the amount of the basic payment.

A peculiarity of calculating the sum insured for a deceased insured person who had previously received a pension is the use of an individual coefficient that has already been used to calculate the payment or (including early payment).

Despite the fact that it is a fixed value established by the state, its size can be increased in the following cases:

  • orphans are paid double the amount for each child;
  • for citizens living in the Far North and areas equivalent to it, is calculated taking into account the regional coefficient applied in these areas.

As for , it too has a number of features when establishing payment:

  • for orphans, the individual scores of both parents are summed up;
  • for children of a deceased single mother, this value is doubled;
  • If the deceased breadwinner has the right to an insurance pension during his lifetime and there is no application for its appointment, increasing coefficients may be applied.

Like a fixed amount, they are established by the government of the Russian Federation. According to the adopted legislation, the values of these quantities are subject to annual indexation by the price growth index for the past year.

Taking into account last year’s inflation, the indexation coefficient in January 2019 was 1.0705. Consequently, the values of SPK and PV are currently equal RUB 81.49 And 2491.45 rub. respectively.

How is pension paid to dependents?

To establish insurance compensation it is necessary take next steps:

  1. Collect the necessary package of documents:
    • passport or residence permit (depending on citizenship);
    • death certificate of the breadwinner or a court decision on his unknown absence;
    • documents confirming relationship with the deceased;
    • the breadwinner’s work book and other certificates, contracts, extracts from orders, allowing to determine the duration of his insurance period;
    • additional documents.
  2. Contact the territorial office of the Pension Fund with a written application.
  3. Wait to receive the result of reviewing the documents within 10 working days after submitting the application or after receiving the last missing document within three months from the date of the initial application.
  4. In case of a positive decision, receive a pension according to the payment method you specified.

When does payment start?

Date of receipt of survivor's pension payment depends on two things:

  • day of submission of documents;
  • the day the right to a pension arises.

Exists Several variants pension payments:

  1. If the insured person applies within a year from the date of death of the breadwinner, then the payment will be assigned from the date of death; if the application period exceeds a year, the pension will be set 12 months earlier than the date of application.
  2. If the last missing document is submitted before the expiration of three months from the date of application, then payment will be assigned from the date of application, taking into account payments for the missed months.
  3. Transferring a citizen from one type of pension to another implies the start of payment from the next month after the insured person submits an application for transfer, but not before the right to this type of pension arises.

With the latter option, a positive decision by Pension Fund specialists can be made if the amount of the survivor’s pension exceeds the amount of the already established payment.

In any case, you can apply for a survivor’s pension at any time from the date of entitlement to it.

Until what age is a survivor's pension paid?

Insurance payment for the loss of a breadwinner is established for the entire period confessions person receiving a pension disabled. This fact is the main thing of such a pension.

You can select individual cases up to what age it is paid:

  • before turning 18 years old;
  • up to 23 years of age if the child continues to study full-time;
  • until graduation, if this period occurs before the age of 23;
  • for life, if by the time of majority there is a certificate of disability;
  • until the child’s breadwinner turns 14 years old, if we are talking about payments to an unemployed relative caring for him;
  • for life, if we are talking about a spouse, parents, grandparents who have reached the retirement age of 60 and 55 years (for men and women, respectively).

Thus, at the age up to which the survivor’s pension is paid, influenced by the category of its recipient. This period may not be limited.

Is it paid after marriage?

A special case of payment of pension benefits upon the death of a breadwinner-spouse is the subsequent marriage of his wife. It is worth noting that according to paragraph 7 of Art. 10 law “About insurance pensions” this fact is not an obstacle to the possibility of receiving insurance benefits for the loss of a breadwinner if you have the right to it.

Consequently, upon entering into a new marriage, the spouse of the deceased insured person the right to a pension will remain, and she will continue to receive it in the same amount.

Payment to students on academic leave and military personnel

Also, special cases of transferring an insurance pension are the following:

  • academic leave;
  • Military service.

In the first case, we are talking about full-time students who, for one reason or another, need to take an academic leave. Moreover, the reasons can be very different: illness, personal desire, and maternity leave. It is worth noting that this fact, as well as the reason for such a vacation, do not matter. The citizen continues to be a full-time student, which means right to a survivor's pension until he graduates or reaches 23 years of age saved.

In the second case, we are talking about a citizen who is already 18 years old. After entering an educational institution as a full-time student, he decides to quit his studies and join the army. This fact will undoubtedly become an obstacle to the possibility of receiving a pension and his payment will be stopped. The justification for this fact is that this citizen is fully supported by the state while serving in the army. However, after returning and enrolling again, a full-time student can again apply for a survivor’s pension until he turns 23 years old.

When do pension payments to dependents stop?

Pension benefits for dependents may be completely terminated in the following cases:

  1. end of the study period;
  2. expulsion from an educational institution;
  3. transfer from full-time to evening or part-time studies;
  4. recognition of the pension recipient as able to work;
  5. the presence of documents or circumstances affecting the right to receive such a pension;
  6. assignment of another type of pension provision;
  7. after six months have passed from the date of suspension of payment;
  8. written refusal of the recipient from the insurance payment.

Termination of pension provision for dependents occurs from the next month in which the above circumstances occur.

In each of the above cases, the citizen is obliged inform the Pension Fund in a timely manner about the circumstances affecting the continuation of payment or its cancellation. This needs to be done to prevent overpayment, since if it occurs, excess amounts will be withheld from the pension or collected in court.

Methods of payment and delivery of pensions

The survivor's insurance pension is a monthly payment; it is transferred to the recipient for the current month.

Methods for paying compensation upon the death of a breadwinner depend directly on its recipient:

  • if this is a minor child or a person who has reached this age but is declared incompetent, then the accrued amount is due to the parent or guardian;
  • if this is a teenager who has reached the age of 14, then he has the right to independently apply for the establishment of a pension;
  • if this is an orphan child who finds himself in a children's institution, then the amounts due to him are transferred to a bank account opened in his name by the administration of such an institution.

You can receive pension benefits not only personally, but also by proxy. The procedure for its issuance is determined by the legislation of the Russian Federation. According to paragraph 19 of Art. 21 laws “About insurance pensions” If there is a power of attorney whose term exceeds a year, the pensioner must annually confirm the fact of registration at the place of receipt of the payment.

There are several types of pension provision:

  • through post offices (possible to receive at home or at the institution’s cash desk);
  • through a bank (to a bank card account or directly at a bank branch);
  • through a special organization engaged in delivery (at home or in the organization itself).

In the future, the pensioner has the right to change the delivery method, for which he will need to contact the Pension Fund at the location of the pension file and write a corresponding application.

That is, under certain conditions the amount increases. In addition, the payment is subject to annual indexation to the amount of inflation recorded for the previous period.

The last indexing was carried out on April 1, 2018. Thus, the amounts of the corresponding benefits are set at the level:

  1. RUB 5,180.24:
    • children who have lost one parent;
    • other disabled recipient citizens;

Social supplement to pension and its minimum

The purpose of social pension payments is to ensure a minimum acceptable level of material support for the beneficiary. In this regard, adjustments are made to the amounts caused by the insufficiency of the pension to achieve the stated goals
.

Attention: the additional payment is determined by the value of the citizen’s subsistence level (SML).

Two parameters are taken into account:

  • SGP established for the entire country;
  • SGP in the region of residence.

To adjust (increase) the payment, the one that turns out to be larger is used (Article 12.1 of Law No. 178-FZ of July 17, 1999).

  1. Serenko E., living in the capital, was assigned a social loss benefit in the amount of 5034.25 rubles.
  2. The minor Ivshchenko A., registered in the Republic of Kalmykia, receives the same state support.
  3. To find out the right to social benefits and its value, we study the SGP indicators:
    • in Russia - 8540 rubles;
    • in Moscow for pensioners - 11,428 rubles;
    • in the Republic of Kalmykia for children - 7440 rub.
  1. According to the current methodology, SGP indicators in the regions are compared with the same for the country and the amount of payments to beneficiaries:
    • Each recipient is assigned minimal assistance, which does not reach the level of the SGP in the corresponding region.
    • The SMG in the capital is higher than in Russia, therefore, Serenko E.’s social pension will be subsidized to the level of 11,428 rubles.
    • The SMG in the Republic of Kalmykia is lower than the same in the Russian Federation, which means that the pension of the minor Ivshchenko A. will be increased to the level of 8540 rubles.

Attention: additional payment is made by:

  • Pension Fund, additional payment is made only if the SGP in the Russian Federation is significantly higher than the SGP level in the region. This additional payment is made in an undeclared form from the moment the pension is assigned;
  • social protection authorities to the level of SGP of the region.
Important: Federal social supplement and regional social supplement are made only to non-working pension recipients. If the fact of work is discovered, the additional payment stops. The pension recipient will be required to reimburse the overpaid amount. Download for viewing and printing:

  • child's residence;
  • or legal representative;
  • the location of a government institution in which a recipient of any age is kept.

To select a delivery method or change it, you must notify the territorial office of the Pension Fund of the Russian Federation by submitting a delivery application.

Will the pension be canceled if the recipient gets a job?

The main condition for the appointment of this type of state support is the recipient’s disability. This means that if this person starts working, then the transfers to him will stop. However, there is an exception for full-time students
.

Attention: young people receiving full-time education will not have their social pension canceled for any type of employment. They will stop paying social security.

However, it should be remembered that if students aged 18 to 23 are expelled from an educational institution for any reason, the right to state aid is completely lost. This rule does not affect students on academic leave. After all, they are still listed as full-time students at the university.

Important: it is imperative to inform the Pension Fund about changes in circumstances affecting the assignment of social pensions. Illegally paid funds are forcibly recovered from fraudsters.

Dear readers!

We describe typical ways to resolve legal issues, but each case is unique and requires individual legal assistance.

To quickly resolve your problem, we recommend contacting qualified lawyers of our site.

For the purpose of social protection of a person who due to circumstances beyond his control cannot provide for himself financially, in addition, he lost a loved one (people) who passed away, who was his breadwinner, the state has developed a set of measures to allow material support this category of the population in the form of a social pension for the loss of a breadwinner.

These activities are regulated by Federal Law dated December 15, 2001 N 166-FZ , according to which social pension benefits in the event of the death of the breadwinner are established:

  • Children whose one or both parents have died, as well as the children of a single mother who has passed away.
  • Provided that they do not have the right to receive on this basis, since their parents (parent) during their lifetime were unable or did not have time to earn money.
  • For the period until these children become able to work, and in certain cases indefinitely.
  • In amounts depending on whether the child has a second parent receiving income.

Recognition of a citizen as missing, properly formalized, also gives the right to receive social pension support in the event of the loss of a breadwinner.

Who is paid the survivor's pension?

Social pension benefits in the event of the death of a breadwinner are paid from the federal budget. Subject to certain conditions, the right to receive it are: disabled persons who have lost their parents due to their death or confirmed unknown absence.

To assign survivor benefits The citizenship of the recipient does not matter. They can be either a citizen of the Russian Federation or a citizen of another country, as well as a person who does not have any citizenship. The main thing is that he appears permanent residents on the territory of our country and met other conditions for the establishment of social pension support.

To recipients of the above benefits by law belong:

  • children under 18 years of age who have lost either one or both parents.

Will you be paid a survivor's pension if you get a job?

A social pension in the event of the death of a breadwinner is a measure of social support for citizens who, due to their minor age or due to full-time education, cannot fully provide for themselves.

In accordance with Art. 11 Federal Law of December 15, 2001 N 166-FZ “On state pension provision in the Russian Federation” payment of social pension benefits for the loss of a breadwinner is established only for disabled persons.

The legislation stipulates the abolition of pension payments upon employment only to recipients of old-age social benefits. For other recipients, availability of official earnings to pay social pensions does not affect. However, if a pensioner was assigned a social supplement up to the subsistence level, then it will be canceled for the period of working activity. Therefore, when applying for a job, you should notify the pension authority of the Russian Federation about this to avoid unjustified excessive payment of amounts and their deduction.
